Direct from the hearing Michael Collins Today's hearing on the abuse of presidential powers before the House Committee on the Judiciary turned into a devastating political ambush by Chairman John Conyers (D-MI), committee Democrats, and the extraordinary panel of witnesses.. At least 12 Democratic Committee members were present plus the Chairman while only four Republicans bothered to show up. Belying their casual appearance in the committee chambers, the Democrats presented a well coordinated, hard hitting case against President George W. Bush. This led to a double climax in the form of surgically erudite testimony by conservative legal scholar Bruce Fein, a former Reagan administration official, and former Los Angeles District Attorney Vincent Bugliosi's stunning summary statement. The best the Republicans could offer was inappropriate humor by Rep. Dan Lungren (D-CA) and a request to clear the chambers when the audience cheered Mr. Bugliosi's remarks. The hearing resulted from the non stop campaign for the impeachment of President George W. Bush by Rep. Dennis Kucinich (D-OH). That effort received an overwhelming endorsement last week with the votes of a 238 majority in the U.S. House of Representatives. The 229 Democrats and 9 Republicans voted to refer the single count impeachment bill to the House or Representatives Committee on the Judiciary chaired by Rep. John Conyers (D-MI). The Kucinich Resolution - H.R. 1345 outlines the case for the impeachment of President Bush. Specifically, as president, Bush: "Deceived Congress with fabricated threats of Iraq Weapons of Mass Destruction (WMD) to fraudulently obtain support for an authorization for the use of force against Iraq and used that fraudulently obtained authorization, and then acting in his capacity under Article II, Section II of the Constitution as Commander in Chief, to commit US troops to combat in Iraq." There was speculation prior to the hearing that the Republicans might scuttle the entire process due to House rules that prevent disparaging comments about the president. Apparently they failed to read the entirety of House Practice, Sec. 25 which lists a number of negative comments that House members have used in the past and makes clear that they're available in the present. "Few Issues More Important" Chairman Conyers opened the hearing by noting that there are "few issues more important" than the actions of Congress to curtail the abuse of presidential powers. As a member of the House committee that heard the Nixon Impeachment case, he speaks with a certain authority. He listed the various abuses of presidential power by Bush laying out the case that his fellow Democrats would elaborate. The senior member of the committee, Republican Lamar Smith (R-TX) responded that he'd seen a lot from this committee but today's hearing was like "hosting an anger management class." Rep. Robert Wexler (D-FL), a strong advocate for the hearings, responded by pointing out that given the evidence of high crimes, this isn't a Democratic or Republican issue, it's an American issue. The Democrats continued the theme of gravity with Cong. Zoe Lofgren (D-CA) referring to Bush as "the worst president our country has ever suffered" Cong. Sheila Jackson Lee (D-TX) returned to what would lead to the most devastating and startling charges of the hearing - the basis for the invasion of Iraq and the disregard for civil liberties through the torture of foreigners and the domestic assault on privacy. Rep. Trent Franks (R-AZ) responded that the hearing was nothing but "a do-over that amuses our terrorist friends." "If lying about casual sex" is an impeachment issue, "then certainly lying to the American people about invading Iraq" is, responded Rep. Hank Johnson (D-GA). Rep. Tammy Baldwin (D-WI), another strong supporter of impeachment, continued the hard hitting attack.... In his resolution, Rep. Dennis Kucinich (D-OH) argues that Bush knew that the Iraqis had no weapons of mass destruction, yet claimed that they did in order to justify the March 2003 invasion. The "fraudulent misrepresentations," as they're referred to in the resolution, cost lives, compromised national security, and represented a clear abuse of constitutional power. The evidence supporting these claims is highly persuasive.
For the most part, the witness statements from House members and the panel of invited witnesses contain specific justifications for impeachment. The Kucinich resolution for impeachment, H. Res 1345, offers a concentrated body of evidence substantiating the charges and demonstrates the main charge in the resolution: the president knew that he was misrepresenting the facts about Iraq at the time he was doing it. In the resolution, Rep. Kucinich lists corrections for each of the false assertions made by the president to justify the Iraq invasion. In addition, the resolution provides excerpted evidence and sources to support each correction of the president's fabricated rationale. The statements in single quotes in the Kucinich resolution text below are from the president's justifications for war. From the resolution: 1. Iraq was not 'continuing to possess and develop a significant chemical and biological weapons capability.' The facts from that time don't come close to justifying the use of force. As demonstrated in the resolution, the president's case for war was based on "fraudulent representations made to Congress," the military, and the citizens of the United States. Maybe we shouldn't be surprised. In 2003 Sen. McCain voted against forcing insurance companies to cover birth control.1 And this is the same senator who claimed in 2007 not to know whether condoms prevented sexually transmitted diseases.2 Nonetheless, the truth remains: American women deserve better than this.
On a Thursday morning we left Tyre and traveled south to visit with more survivors and survey some of the other small towns. The first one we came to was Qana. Lebanese Christians believe this is where Jesus performed his first miracle, turning water to wine.
Qana also has a long, sad history of conflict. Perhaps most notably in 1996, when an Israeli missile attack hit a UN tent where the townspeople had fled for safety. Israel claimed a rocket launcher had been located nearby making the tent a viable target, but more than 100 civilians died that day.
In the 2006 war, Qana was peppered with clusters throughout the town and surrounding hills. This is the story of one small survivor.

Md. Police Infiltrated Groups Opposed to War and the Death Penalty

Max Obuszewski is a seasoned, nonviolent peace activist in Maryland. But to the Maryland State Police, he is suspected of committing the "primary crime" of "terrorism -- anti-war protestors" and the "secondary crime" of "terrorism -- anti-govern."
That is how the Maryland State Police designated him in internal documents that the ACLU of Maryland obtained through a lawsuit and released on July 17. The documents also show that the Maryland State Police entered his name into a database dealing with "high intensity drug activity." These documents reveal an elaborate undercover operation against peace groups and anti-capital-punishment groups.
Nine Reasons to Investigate War Crimes Now

Retired General Antonio Taguba, the officer who led the Army's investigation into Abu Ghraib, recently wrote in the preface to the new report, Broken laws, Broken Lives:
"There is no longer any doubt as to whether the current administration has committed war crimes. The only question that remains to be answered is whether those who ordered the use of torture will be held to account."
Should those who ordered war crimes be held to account? With the conclusion of the Bush regime approaching, many people are dubious, even those horrified by Administration actions. They fear a long, divisive ordeal that could tear the country apart. They note that such division could make it far harder for the country to address the many other crises it is facing. They see the upcoming elections as a better way to set the country on a new path.
Many Democrats in particular are proposing to let bygones be bygones and move on to confront the problems of the future, rather than dwelling on the past. The Democratic leadership sees rising gas prices, foreclosures, and health care costs, as well as widespread dissatisfaction with the direction of the country, as playing in their favor. Why risk it all by playing the war crimes blame game? Perhaps some Democratic leaders are also concerned that their own role in enabling or even encouraging war crimes might be exposed.
Meanwhile, the evidence confirming not only a deliberate policy of torture, but of conspiring in an illegal war of aggression and conducting a criminal occupation, continues to pile ever higher. Bush's own press secretary Scott McClellan has revealed in his book, What Happened, how deliberately the public was misled to foment the attack on Iraq. Philippe Sands' new book, Torture Team, has shown how the top legal and political leadership fought for a policy of torture -- circumventing and misleading top military officials to do so. Jane Mayer's The Dark Side, reveals that a secret report by the Red Cross -- given to the CIA and shared with President Bush and Condoleezza Rice -- found that U.S. interrogation methods are "categorically" torture and that the "abuse constituted war crimes, placing the highest officials in the U.S. government in jeopardy of being prosecuted."
Despite the reluctance to open what many see as a can of worms, there are fresh moves on many fronts to hold top U.S. officials accountable for war crimes.
Courts: U.S. courts have issued a barrage of decisions against the Administration's claim that they can do anything and still be within the law. The Supreme Court ruled June 12 that the Administration cannot deny habeas corpus rights to Guantánamo detainees. The DC Circuit Court of Appeals on June 30 overturned the Pentagon's enemy combatant designation of a Chinese Muslim held in Guantánamo for the last six years. A Maine jury in April acquitted the Bangor Six of criminal trespass charges stemming from protesters' claim that the "Constitution was being violated by the Bush Administration's involvement in Iraq."
Congressional investigation: Rep. John Conyers has recently brought top policy-makers, including former Deputy Assistant Attorney General John Yoo, Vice President Cheney's Chief of Staff David Addington, and this week former Undersecretary of Defense Douglas Feith and former Attorney General John Ashcroft before a House Judiciary subcommittee and grilled them on their role crafting the Administration's torture policy.
Senate hearings in June revealed that treatment of Guantánamo captives was modeled on techniques allegedly used by Communist China to force false confessions from U.S. soldiers.
Impeachment: Despite Majority Leader Nancy Pelosi's instruction to keep impeachment "off the table," Rep. Dennis Kucinich for the first time brought an impeachment resolution to the House floor that incorporated a devastating, thirty-five article indictment spelling out Bush Administration war crimes and crimes against the Constitution. Now Rep. Conyers has announced that the Judiciary Committee will hold hearings on the charges July 25. Even after the Bush Administration leaves office, the judges it appointed who appear complicit in war crimes -- notably torture policy architect Judge Jay S. Bybee -- could still be impeached.

Somewhere in the White House, Bush is beaming. This afternoon, the Senate voted 69 to 28 to -- once and for all -- pass the FISA "compromise" legislation. With its vote, "the Democratic-led Congress ... voted to put an end to the NSA spying scandal," writes Glenn Greenwald, whose commentary on the FISA fight has been unparalleled for months. In effect, he says, it was a vote "to immunize lawbreaking telecoms, terminate all pending lawsuits against them, and vest whole new warrantless eavesdropping powers in the President." According to the New York Times, which first broke the story on Bush's illegal wiretapping program, "When the president signs the bill, as expected, it will effectively dismiss some 40 lawsuits filed against telecommunications companies for alleged violations of wiretapping and privacy laws."
While it may not be an unexpected defeat, it is a painful one. It has been a long and arduous road. Just two weeks ago, with a Senate vote on FISA imminent (before Congress decided at the last minute to wait until after the July 4th break), I called the Democrats' capitulation on FISA "a sad, sputtering end" to a long national nightmare. The same applies now. "With their vote today," says Greenwald, "the Democratic-led Congress has covered-up years of deliberate surveillance crimes by the Bush administration and the telecom industry, and has dramatically advanced a full-scale attack on the rule of law in this country."

For years now, the U.S. political press corps has traveled with John McCain on his “Straight Talk Express,” buying into his image as a paragon of truth-telling. But the real truth is that McCain routinely makes stuff up, as he did on June 11 in lying about Barack Obama’s “bitter” comment.
During a political talk in Philadelphia, McCain claimed that Obama had described “bitter” small-town voters as clinging to religion or “the Constitution” – when the second item in Obama’s comment actually was “guns.”
